17-03-2010 Nieuwe restricties SMS & Win In Belgie
In Belgie zullen er per 1 april wijzigingen plaatsvinden in o.a. de wetgeving met betrekking tot kansspelen. Dit houdt in het kort in dat kansspelen zoals de SMS en Win die op dit moment aangeboden wordt in België niet meer zonder meer is toegestaan. De wet definieert elke vorm van wedstrijd, kwis of spel waarbij een inleg plaatsvindt een kansspel. In het geval SMS en win wordt de premium MO en premium MT al gezien als een inleg. Om toch kansspelen te kunnen doen moet aan een aantal voorwaarden voldaan worden.
De voorwaarden zijn als volgt:
1. de organisator moet een licentie aanvragen bij de Kansspelen commissie.
2. Indien er een licentie is verleend dan moet dit aan de operatoren worden doorgegeven en geven die ook een accoord hierop.
3. elke organisator van een kansspel moet dit op een dedicated shortcode doen in de 6xxx-reeks. Deze diensten kunnen dus niet meer op een shared shortcode worden gedaan en elke organisator krijgt een eigen shortcode.
4. de organisator moet een lokale bedrijfsregistratie in België hebben.
Dit houdt effectief in dat per 1 april geen SMS en Win diensten meer zijn toegestaan op TargetSMS.nl of TargetPay.com. Indien u wel SMS en Win diensten wilt uitvoeren dan moet u voldoen aan de bovenstaande voorwaarden. U kunt ons daarvan op de hoogte stellen en dan zorgen wij voor de verdere assistentie en procedure. We zullen per 1 april alle SMS en Win diensten deactiveren. Voor verdere vragen kunt u contact opnemen met sales@targetmedia.nl.

Some key points of the new code:
a. Article 12.3 is specifically named for the stop command: STOP on a shared shortcode means that all subscription services on this shortcode should be unsubscribed. For shortcode 3010 and 7733 we will handle this for you, but for customers with their own shortcode it should be implemented by yourself.
b. For subscription services to each message the following should be added "informatie? www.smsgc.nl ".
This means that each job you offer through the Easy subscription services this text should be added. If you offer jobs via the Premium SMS Gateway Advanced you should add this in every message send via the API. If you send messages with a WapPush then this text should be displayed on the wappage that is opened.
c. Article 8.c specifically has instruction fot the 1-on-1 chat services. An important point is that each MO message can only send up to 2 premium MT messages. Up to 72 hours after an MO an MT may be send, so the stalling of MTs is related to maximum duration of 72 hours.
d. For owners of a dedicated shortcode the answer to an MO with the HELP text should be adjusted. See Rule 6.1. For shared short codes (3010 and 7733) this modification will be done by TargetMedia.
e. If a consumer sends a wrong keyword to a shortcode then the answer must meet the same requirements as in a HELP message. See Rule 6.2.
f. Existing customers should not just be accessed through SMS for new services, unless they have given permission for this asset. See section 7.2.
g. Extra attention should be paid to the rate of single communication services, see Article 8.
h. For subscription services the ask-for-confirmation should be free (see Article 11.1) and there is a standard order for the login confirmation (Article 11.2 and 11.3). When you use the Advanced Premium SMS Gateway, which handles the messages on your server, you have to check the confirmation messages and ensure that they meet the requirements. If you use the Easy version of subscription services than we do take care of it.
i. There is a new procedure for complaints from consumers and members of the SMS code, see Article 13
If you use an SMS service through our websites then you are required to comply with this new Code SMS Services. Therefore again the request to read the code carefully and where necessary adapt your services. We welcome your questions and / or comments.
